General Terms and Conditions of KT Flowery Handmade

Article 1 - Definitions

Webshop: KT FLowery Handmade, established in Helmond.
Customer: The natural person or legal entity entering into an agreement with the Webshop.

Products: All crocheted flowers, bouquets, personalized products, and other items offered in the webshop.

Article 2 - Applicability

These general terms and conditions apply to every offer made by the Webshop and to every agreement concluded between the Webshop and the Customer.
By placing an order, the Customer agrees to these general terms and conditions.

Article 3 - The offer and the agreement

Because all products are crocheted by hand, small, unique variations in shape and size may occur compared to the product images on the website. Small variations in color may also occur compared to the product images on the website, as the yarn is constantly being reordered from the supplier. This does not entitle the Customer to dissolution or compensation.
The agreement is concluded at the moment the Customer has completed the order and has received an order confirmation (by email or message on WhatsApp).

Article 4 - Custom Order (Customized bouquets, custom-made bouquets, and customized products)

Products made specifically at the Customer's request (such as customized wedding bouquets, specific color combinations, or custom-made bouquets) fall under Custom Order.
A deposit of 25% of the total amount applies to a custom order. Because it is tailored to the Customer's wishes, this order is non-returnable. A cancellation period of 7 days applies. After this period, cancellation is no longer possible due to the costs incurred.

Should the Customer wish to modify the design in the meantime, the additional costs will be charged. This depends on the number of adjustments made and how far along the process is.

For a custom order, the Webshop and the Customer agree on the specifications (such as flower type, color, and length) digitally (via WhatsApp or email) in advance. After approval and payment, the design cannot be changed free of charge.

Article 5 - Prices and payment

All stated prices are in euros (€).

Prices exclude shipping costs, which are clearly displayed before finalizing the order.

Orders will only be processed or shipped after full payment has been received by the Webshop, unless otherwise agreed in writing (or digitally) (for example, in the case of a down payment for a custom order).

Article 6 - Delivery and delivery time

The Webshop strives to deliver orders as quickly as possible. Because these involve handcrafted items, the delivery time may vary per product:

Ready-made products: Shipment within 14 working days.

Custom Orders / Wedding bouquets: The delivery time is determined in consultation and is usually 3 to 6 weeks.

The stated delivery times are indicative. Exceeding the delivery time does not entitle the Customer to compensation, unless there is intent or gross negligence on the part of the Webshop.

The risk of damage to or loss of products lies with the Webshop until the moment of delivery, unless otherwise agreed. Orders delivered in Helmond are delivered by the Webshop itself. Select 'Helmond' under shipping options and no shipping costs will be charged, regardless of the order amount.

Article 7 – Right of Withdrawal (Returns)

For ready-made products: The Customer has the right to cancel the order within 14 days of receipt without giving reasons. The product must be returned undamaged, unused, and in the original packaging with the return form. The costs for the return shipment are at the Customer's expense.

Exception for Custom Orders: The right of withdrawal does not apply to products made according to the Customer's specifications (such as custom-made wedding bouquets and custom-assembled bouquets). These purchases are final and cannot be returned or exchanged.

Article 8 – Warranty and Complaints

The Webshop guarantees that the products comply with the agreement and the reasonable requirements of soundness and usability.
Crocheted flowers are fragile handmade products and must be handled with care. Damage caused by improper use (such as exposure to moisture, excessive pulling, or direct prolonged sunlight causing discoloration) is excluded from the warranty.

Any complaints regarding defects must be reported in writing within 7 days of receipt of the product via ktflowery@gmail.com,  preferably accompanied by photos. The Webshop will respond within 14 days with an appropriate solution (repair, replacement, or refund).

Article 9 – Intellectual Property

All designs, photos, texts, and patterns on the Webshop's website are the intellectual property of KT Flowery Handmade. None of this may be reproduced without prior written permission from KT Flowery Handmade. Any unauthorized copying, distribution, or commercial use of these materials constitutes an infringement of copyright and intellectual property rights.
